General Terms and Conditions (CGV) - Swellness

Article 1 - Scope

These Terms and Conditions of Sale (CGV) apply to all orders placed on the site www.flpaccessoires-shop.fr (The "Site") for the purchase of products presented on the site (the "products") by the company Swellness.

The applicable GSCs are those in effect on the day of the validation of the order and apply excluding all other conditions.

ARTICLE 2 - ORDERS

Orders are made exclusively on the site. The connection and Internet access costs are the responsibility of the customer.

A control confirmation is sent by email before shipping, making the definitive sale subject to the applicable right of withdrawal.

Article 3 - Availability

The offers are valid until visible on the site and within the limits of available stocks.

In case of unavailability of a product after validation of the order, the customer will be informed by email. The order will be canceled without bank flow. Swelness can offer a quality replacement and equivalent price.

Swellness reserves the right to refuse important orders (from 2 identical items) or customers with previous unpaid bills.

Article 4 - Prices and terms of payment

4.1 Prices can be modified at any time but are invoiced at the rate in effect at the time of the validation of the order.

  • Prices are in euros, all taxes included (VAT included) excluding processing and shipping fees, specified before validation.

  • For deliveries outside EU and DOM-TOM, the price is out of dump and the customer is responsible for customs duties and import taxes.

4.2 Terms of payment:

  • PayPal

The flow rate is carried out at the time of the validation of the order.

Article 5 - Delivery

Delivery times are indicated in working days. For multiple commands with different dates, the delivery date taken into account is furthest. Swellness can split shipments at no extra cost.

The products are delivered to the address indicated by the customer. No sending is done in hotels, professional addresses or posts.

In case of delay greater than 30 days (normal sending) or 14 days (fast sending) for not attributable to the client, it can cancel the order and obtain a refund of the amounts paid. The return fee remain the responsibility of the customer if the product has been received after the cancellation.

Article 6 - Retraction

The customer has a legal deadline for 7 working days To exercise its right of withdrawal on standard orders except for:

  • Custom or custom products

  • Products in pre-order (No refund or exchange, except for lack of proof or error on our part)

Article 7 - Compliance and guarantees

The photos are illustrative. The customer must refer to the description for the exact characteristics.

In the event of a defective, damaged or non-compliant product, Swallness proceeds to an exchange or repayment after return and verification. The return fee are reimbursed on proof.

The Customer also benefits from legal guarantees of conformity and hidden defects: Articles L.211-4, L.211-5, L.211-12 of the Consumer Code and Articles 1641 and 1648 of the Civil Code.

Article 8 - Intellectual Property

Any content of the site (texts, images, graphics, logos) is the exclusive property of swellness or its partners. Any reproduction without authorization is a criminal and civil offense.

Article 9 - Personal data and privacy policy

Personal data is used for:

  • order management,

  • commercial monitoring,

  • sending information or marketing offers with customer consent.

The customer has a right of access, rectification, deletion and opposition.

Article 10 - Applicable law and disputes

The CGVs and Transactions are subject to French law.
